Self-Employed in Nevada With California Clients: California Tax?
For a nonresident service business, the customer’s benefit location can matter even when the work is done in Nevada.
This guide addresses individuals who are California nonresidents operating as independent contractors or sole proprietors. A move to Reno or Sparks does not automatically establish that status. Residency and the sourcing of business income are separate questions; part-year residency requires its own review. FTB’s residency and nonresident guidance explains the distinction.
Where does the customer receive the benefit? /
FTB’s independent-contractor scenario explains that California-source income can arise when a customer receives the service benefit in California, even if the provider works outside the state. Working from a Nevada home office is therefore not, by itself, a reason to exclude the income from California tax. Read FTB’s independent-contractor / sole-proprietor scenario.
California customer versus California benefit /
FTB’s January 2026 technical manual illustrates this with a Nevada-based tax/accounting provider. Services benefiting the customer’s California activity can be California sales under market assignment. In its contrasting example, a California customer buys services for its Nevada business and receives the benefit in Nevada. The customer’s California address alone does not decide the result. See the manual, printed page 47, Example 3.
Business apportionment is a separate calculation /
FTB’s 2025 Schedule R instructions describe market assignment of service receipts and apportionment for qualifying business activity conducted within and outside California. That analysis should not be replaced by a simple count of where the contractor sat while working. Identifying California-assigned receipts is also not the same as calculating a final tax bill.
Keep W-2 work and self-employment distinct /
For ordinary nonresident employee wages, FTB generally looks to where the employee physically performs services, with separate rules for special compensation. Do not assume that framework answers a sole proprietor’s service-business question. Episode 4 covers the W-2 distinction.
